Eligibility Requirements
Qualifying Capital Investment
Must invest the required minimum amount ($800,000 in a Targeted Employment Area, or $1,050,000 elsewhere).
Job Creation Requirement
The investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years.
Lawful Source of Funds
Investors must thoroughly document that the capital invested was obtained through lawful means.
At-Risk Investment
The capital must be placed at risk in a new commercial enterprise or an approved Regional Center.
The Process
Select Investment Project
Choose between a direct investment or investing through a USCIS-approved Regional Center.
File Form I-526E / I-526
Submit the immigrant petition demonstrating the investment and lawful source of funds.
Conditional Green Card
Upon approval, undergo consular processing or adjustment of status to receive a 2-year conditional Green Card.
File Form I-829
At the end of the 2-year period, file to remove conditions by proving the investment was sustained and jobs were created, resulting in a permanent Green Card.
